Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using https://www.kposehn.com (“the Site”) operated by Kristin Posehn Studio (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://www.kposehn.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
INTELLECTUAL PROPERTY
The Site and its original content, features and functionality are owned by Kristin Posehn Studio and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
LIMITATION OF LIABILITY
You agree that Kristin Posehn Studio’s entire liability, and your exclusive remedy, with respect to any services(s) provided under this Agreement and any breach of this Agreement is solely limited to the amount you paid for such service(s). Company shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services.
DELIVERY
Purchased items will be shipped within 7 business days of the order, although most will be within 3 to 4. The duration of shipping will depend on the method of shipping you select. If you still have not received your purchase after 3 weeks, please notifysupport@kposehn.com.
PRODUCT AVAILABILITY
Although availability may be indicated on the Site, we cannot guarantee product availability and products, nonetheless, may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.
RETURN POLICY
No refunds or exchanges will be accepted. All sales are final. In the event of damage during shipping, we require that customers notify Kristin Posehn Studio (support@kposehn.com) of any problems with merchandise within 48 hours of receipt. Items must be in their original packaging, in as-new condition with both the packing slip and the printed receipts.
COLORS
We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.
TERMINATION
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Site may contain links to third-party sites that are not owned or controlled by Kristin Posehn Studio.
Kristin Posehn Studio has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
GOVERNING LAW
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of California, United States, without giving effect to any principles of conflicts of law.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
